A concrete Usage Policy associated with a specific Dataset that has been signed by both the provider and consumer Dataspace Participants. An (electronic data sharing) Agreement is a result of a Contract Negotiation and is associated with exactly one Dataset.
A Electronic Data Sharing Agreement (EDSA) comprises a Usage Policy that describes certain permission or obligation of a Data Space Resource. Electronic Data Sharing Agreements are expressed in a machine-readable format (according to the Dataspace's Usage Policy Language) and are verified as part of the establishment of a data transfer. In any case, a EDSA must always be regarded as an extension of an existing legal agreement between two Dataspace Participants, which can be overruled by them. As the Dataspace technology stack cannot sufficiently interpret legal texts, any EDSA must always be in line with the concluded Data Sharing Contract. Each contract between Dataspace Participants consists of a technical part and a non-technical part. The technical part focuses on the description of technical interfaces (Application Programming Interfaces) and the Usage Policy. The non-technical part focuses on legal aspects of the intended data exchange. For automatic negotiation of contracts and conditions standard contractual clauses and conditions are necessary (but not yet available today).
